An Upton man entered a plea of not guilty in Dedham District Court last Monday to charges arising from a fatal crash on Rte. 109 in Medfield on November 28, according to Norfolk District Attorney Michael W. Morrissey.
Andrew Holman, 41, of Mechanic Street in Upton entered pleas of not guilty to Motor Vehicle Homicide by Reckless Operation, four counts of Assault and Battery with a Dangerous Weapon, four counts of Assault with a Dangerous Weapon, two counts of Leaving the Scene of a Crash involving property damage, Failure to Stop for Police, Speeding and miscellaneous traffic violations.
Holman is alleged to have been traveling at excessive speed on Rte. 109 in Medfield when the Jeep Grand Cherokee he was operating crossed the center line and struck the 2008 Chevy Impala being operated by James Tobia, 31, of Falmouth, killing him.
Prior to colliding with Tobia, Holman is alleged to have struck another vehicle approximately a mile east of the fatal crash. A fourth car, driven by a Medway woman, swerved to avoid Holman and struck Tobia’s Impala; that driver was transported to a local hospital. Holman’s injuries led to his transportation to a Boston hospital via MedFlight medical evacuation helicopter.
Dedham District Court Judge Michael J. Pomarole released Holman on his personal recognizance, but ordered: That he stay away from and have no contact with the victims and the family of the deceased victims; do not drive; continue and comply with any and all mental health treatment; take all prescribed medications as prescribed; sign and not rescind all releases necessary for Probation to monitor said treatment.
He was ordered to return to the Dedham District Court on March 30 for pre-trial conference. Assistant Norfolk District Attorney Christopher Meade represented the Commonwealth at arraignment. Holman was represented by Attorney John Hickey.
The matter was investigated by the Medfield Police Department with assistance from the Collision Analysis and Reconstruction Section and Crime Scene Services Section of the Massachusetts State Police as well as the Motor Vehicle Homicide Unit of the Norfolk District Attorney’s Office.
